Iqama Case: Khwaja Asif challenges formation of IHC bench

 ISLAMABAD:Minister for Foreign Affairs Khawaja Asif Monday challenged the formation of a larger bench of Islamabad High Court (IHC) to hear his case against disqualification over possessing an Iqama (work permit).

The larger bench headed by Justice Aamir Farooq comprising Justice Mohsin Akhtar Kayani and Justice Miangul Hasan Aurengzeb assumed hearing of the case filed by Pakistan Tehreek-e-Insaf leader (PTI) leader Usman Dar.

During the course of proceedings, the counsel for Khawaja Asif sought more time to submit reply in the matter and also filed a civil miscellaneous appilcation (CMA ) challenging formation of the larger bench.

Khawaja Asif contented that by constituting a larger bench his right of appeal had been affected and that the petitioner had gone through all legal remedies to get him (Asif) disqualified as member of the parliament.

The bench, however, accepted his request to grant more time for submission of reply and adjourned hearing of the case till November 30.

The petitioner has sought quo warranto (power of the high court to enquire about the legal position of any public servant on the complaint of any citizen) proceedings against Khawaja Asif. —APP
