ISLAMABAD: A three member bench headed by Justice Mian Saqib Nisar will hear the appeal filed by the federal Government against the decision of the Sindh High Court regarding the removal of General (Retd) Pervez Musharraf’s name from the Exist Controle List (ECL) on Monday (June 16).
Other members of the bench are Justice Asif Saeed Khosa and Justice Ijaz Afzal Khan according to the cause list issued by the Supreme Court here on Saturday.
It may be mentioned here that the Sindh High Court has issued a more than forty page judgment on June 12.
The bench of the Sindh High court has struck down the name of Gen. (Retd) Pervez Musharraf from the ECL conditionally giving fifteen days time to the federal Government for filing appeal in the Supreme Court if desires.
The bench also mentioned that the operation of the judgment will remain suspended for fifteen days only.
Following are the operational paras of the judgment are:
“As a result of above discussion, this petition is admitted to regular hearing and disposed of in the following terms:- (a). The Memomrandum No. 12/744/2013-ECL, dated 5th April 2013, placing the name of General (Retd) Pervez Musharraf on Exist Control List is struk down. (b). Since the direction contained in this judgment is self executiry, therefore, the operation of this judgment is suspended only for fifteen days, during which the respondents, if so desire, may file appeal in the honourable supreme court. (C) Pending applications are also disposed of accordingly.”
